Welcome to ZooMate. These Terms of Service ("Terms") are a legal agreement between you and ZooMate ("we," "us," or "our") that govern your use of the ZooMate mobile application and related services (the "Service"). Your use of the Service is also subject to our Privacy Policy, which is incorporated by reference. By downloading, installing, or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
You must be at least 13 years old to use ZooMate. If you are between 13 and the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed these Terms with you. If you're using the Service on behalf of an organization, you confirm you have authority to bind that organization to these Terms.
You're responsible for keeping your account credentials confidential and for everything that happens under your account. If you sign in with Apple, the security of your Apple ID is governed by Apple. If you use a username and password, choose a strong password and don't share it. Notify us at zoomateserver@gmail.com immediately if you suspect unauthorized access. We may lock an account temporarily after repeated failed login attempts as a security measure.
You may delete your account at any time from Settings → Account → Delete Account. Deletion is irreversible — see the Privacy Policy for what happens to your data.

We reserve the right to investigate suspected violations and to take any action we believe is appropriate, including content removal, account suspension, or termination.
You may post content to the Service — animal profiles, photos, posts, comments, and similar material ("Your Content"). You retain ownership of Your Content. By posting it, you grant ZooMate a worldwide, non-exclusive, royalty-free license to host, store, transcode, back up, and display Your Content for the purpose of operating and providing the Service to you and to other users in accordance with your privacy settings (e.g., displaying your public posts in feeds, generating thumbnails, syncing across your devices). This license ends when you delete the relevant content or your account, except for backups that may persist for up to 30 days as described in the Privacy Policy.
You represent that you own or have the necessary rights to Your Content and that posting it does not violate anyone's rights.
Zero-tolerance policy for objectionable content and abusive behavior. We do not tolerate content that is illegal, hateful, sexually explicit, harassing, or that depicts animal abuse. Every user can report objectionable content or block another user from inside the app. Reports are reviewed and acted on within 24 hours — confirmed violations result in content removal and may result in account termination. To report content or a user outside the app, email zoomateserver@gmail.com with details and any relevant screenshots.
Copyright (DMCA) notices. If you believe content on the Service infringes your copyright, send a notice to zoomateserver@gmail.com with: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) identification of the allegedly infringing material and where it appears on the Service; (4) your contact information; (5) a statement that you have a good-faith belief that the use is not authorized; (6) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the rights holder. We will respond to valid notices and may remove content and terminate repeat infringers' accounts.
ZooMate offers optional Premium subscription tiers (currently Pro and Pro+) and a Lifetime upgrade. Current pricing and features are shown in the app prior to purchase.
The following terms apply to all auto-renewing subscriptions purchased through the Apple App Store:
The Lifetime upgrade is a one-time, non-recurring purchase that grants ongoing Premium access for as long as the Service operates and your account remains in good standing. Lifetime access may be revoked if Apple refunds the underlying transaction, if the purchase is reversed for fraud or chargeback, or if your account is terminated for a material violation of these Terms.
All payments are processed by Apple. We do not issue refunds directly. To request a refund, use Apple's standard process at reportaproblem.apple.com.
The free tier of ZooMate displays advertising delivered by Google AdMob. Ad delivery and the privacy choices that control it (App Tracking Transparency / SKAdNetwork) are described in our Privacy Policy. Premium subscribers do not see ads.
The Service relies on third parties — Apple (App Store, in-app purchases, Sign in with Apple, push notifications, SKAdNetwork), Google AdMob (ads in the free tier), Railway (hosting), and Google Gmail (transactional email). Your use of those third parties' features may be subject to their own terms and policies. The Privacy Policy describes what data each receives.
ZooMate helps you record and organize information about your animals' care. It is not a veterinary service and does not provide medical advice, diagnosis, or treatment. Any care suggestions, schedules, dosing reminders, calculator outputs, or content posted by other users are informational only and are not a substitute for professional veterinary judgment. Always consult a licensed veterinarian for medical decisions affecting your animals. We are not responsible for any harm resulting from reliance on the Service in place of professional advice.
The Service, including the ZooMate name, logo, app code, server software, designs, and all related intellectual property, is owned by us or our licensors and is protected by copyright, trademark, and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. Nothing in these Terms transfers ownership of any part of the Service to you.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access (with or without notice) if we reasonably believe you have violated these Terms, if your account is being used fraudulently, if continued operation poses a risk to other users or to the Service, or if we are required to do so by law. Upon termination, your right to use the Service ends immediately. Sections of these Terms that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and governing law) will survive.
We also reserve the right, in our sole discretion and without cause, to terminate any individual user's access to the Service, or to discontinue the entire Service, at any time. If we exercise this right we will give at least 30 days' advance notice by email to the address associated with the affected accounts. No refunds (including for unused subscription periods or Lifetime purchases) will be provided in connection with such termination or discontinuation. We may, but are not obligated to, release a locally-installable version of the app so that existing users can continue to use it offline after the Service is shut down — this is not a guarantee, and we make no commitment as to the timing, features, supported platforms, or ongoing maintenance of any such release.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. We do not warrant that the Service will be uninterrupted, error-free, secure against attack, or that any defects will be corrected. We do not warrant any content posted by other users.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZOOMATE AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $50.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In those jurisdictions, the above limitations apply to the maximum extent permitted.
You agree to defend, indemnify, and hold harmless ZooMate from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with (a) your use of the Service, (b) Your Content, (c) your violation of these Terms, or (d) your violation of any rights of a third party.
You acknowledge that these Terms are between you and ZooMate, not Apple, and that Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for the Service. If the Service fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app — to the maximum extent permitted by law, Apple has no other warranty obligation. ZooMate (not Apple) is responsible for addressing any claims by you or any third party relating to the Service or your use of it, including product-liability claims, claims that the Service fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation. ZooMate (not Apple) is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual-property claim that the Service infringes that third party's intellectual-property rights. You represent that you are not located in a country subject to a U.S. government embargo or designated as "terrorist supporting" and are not on any U.S. government list of prohibited or restricted parties. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
These Terms are governed by the laws of the State of Connecticut, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Hartford County, Connecticut, and you and ZooMate consent to personal jurisdiction in those courts. Nothing in this Section prevents either party from seeking injunctive relief in any court of competent jurisdiction.
If you are a consumer in the European Union, United Kingdom, or another jurisdiction whose laws grant you mandatory consumer-protection rights, those rights are not affected by this Section.
Entire agreement. These Terms (together with the Privacy Policy and any in-app purchase terms presented at the time of purchase) constitute the entire agreement between you and ZooMate regarding the Service and supersede any prior agreements.
Severability. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.
No waiver. Our failure to enforce any right or provision will not be deemed a waiver of that right or provision.
Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
Force majeure. Neither party is liable for delays or failures caused by events beyond its reasonable control, including natural disasters, network outages, third-party service failures, war, terrorism, or government action.
No third-party beneficiaries. Except as expressly provided in Section 15 (Apple) and Section 4 (DMCA notice senders), these Terms do not create any third-party beneficiary rights.
We may update these Terms from time to time. Material changes will be communicated via in-app notice or email at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. The "Last updated" date at the top of this page reflects the most recent revision.
